1. Introduction

Welcome to the Postscript Books Ltd terms and conditions. The terms set out below will apply when you place an order for our products and you agree to be bound by them. Please read these terms carefully and make sure that you understand them before ordering any product from our website. 
Terms may be changed and updated from time to time and any changes will be effective from the publication of the new terms on the website. Every time you wish to order products, please check these terms to ensure you understand those that will apply. These terms do not affect your statutory rights. 3. Use of Website  

This website is operated by Postscript Books Ltd, formerly Sandpiper Books Ltd. 
These terms, together with our Privacy Policy, apply to your use of and access to the website. These terms will apply to any contract between us for the sale of any product and apply to your use of this website. By accessing, using and placing an order on this website you agree to be bound by these terms. If you do not agree to these terms, you must cease using and accessing this website.

By registering as a user of this website, you agree that the personal information you provide is true, accurate, current and complete in all respects and that you will notify us of any changes to your personal information by contacting us by one of the following means:

4. Purchase of products


a. Ordering

By placing an order with Postscript Books ltd you confirm that you are at least 18 years old and legally capable of entering into binding contracts.

 

b. Contract

When buying products from us, you are entering a legally binding contract. All orders are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances. Providing you have supplied us with an email address, we will confirm acceptance of your order by sending a confirmation email. The contract between us will only be formed once your offer of payment has been received by us.


5. Cancellation

We reserve the right to cancel the contract between you and us if:
•    we have insufficient stock to supply the products you have ordered
•    we do not deliver to your area
•    one or more of the products ordered was listed at an incorrect price
•    we have reason to believe the order placed is fraudulent 
If we cancel your order we will notify you by email or telephone and will refund the payment amount as soon as possible. 


6. Product descriptions

Every care has been taken to ensure the descriptions of products are correct. We aim to keep the website as up to date as possible. However, the information on this website may not always reflect the position exactly at the moment you place an order. 


7. Price and payment

All prices are in £ Sterling, inclusive of VAT (where applicable) and exclusive of delivery charges. If you are paying by credit/debit card, payment for your order will be charged at point of order confirmation. If you are paying by cheque, payment for your order will be charged when we deposit your cheque.
If you pay using PayPal, you will be directed away from our website to complete your payment transaction. We have no control over this or any other linked site, all of which have separate privacy and data collection practices, independent of us.


8. Delivery

Our delivery options and charges are specified on our website under Delivery Information. Shipping outside of the UK incurs variable delivery charges based on the product weight and destination country. It may not be possible to deliver to some locations.
We will deliver your order to the address you provided us during the ordering process. You become the owner of the products you have ordered when they are despatched to you. Once products have been delivered to you, they will be held at your own risk and we will not be liable for their loss or destruction.


Force majeure

Postscript Books shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so, or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control such as extreme weather, outbreak of disease, epidemic, pandemic, war, terrorist attack or civil emergency.


9. Returns

If any part of your order is damaged or faulty, or you are not satisfied with your purchases, please contact Customer Services on 01626 897123 within 15 days of receiving your order and we will arrange either a replacement or full refund. If any product which forms part of a set or collection is returned to us for a refund or exchange, please return all items in that set.

 

10. Customer credit balances

Customer credit balances relating to goodwill will expire after 2 years from inception. Credit balances relating to an overpayment from customers will be written off after 6 years. If a credit balance relating to an overpayment is requested after this time then an eGift voucher may be provided at our discretion. 

 

11. Privacy

We process information in accordance with our Privacy Policy.

 

12. Limitation of liability

We make no guarantee that our website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected or that the site or the server that makes it available are free of viruses or bugs, or represents the full functionality, accuracy or reliability of the website.
The company assumes no responsibility for indirect losses as a result of your use of the website.

 

13. Social media competitions

The promoter is Postscript Books Ltd
•    Competitions are open to anyone of 18 years and over, with the exception of employees of the company and their close family. There is no fee to enter, and no purchase is required. Only one entry per person will be accepted.
•    By entering a competition, an entrant is agreeing to be bound by these terms.
•    No responsibility can be accepted for entries not received for any reason.
•    The company reserves the right to amend or cancel the competition and these terms without notice. Any changes to the competition will be notified to entrants as soon as possible by the promoter.
•    The prize is as stated on the competition post. No alternatives, returns or exchanges are offered.
•    The winner(s) will be announced on the social media platform on which the competition is running. The winner(s) will be required to contact us with an address to which the prize can be sent.
•    If the winner does not claim the prize within 15 days, the prize can be withdrawn from the winner and a replacement winner chosen.
•    The promoter’s decisions regarding all aspects of the competition are final.
•    The competition will be governed by English law and the exclusive jurisdiction of the courts of England shall apply.
•    When a competition is announced, the following details will be given: the closing date, how the winner will be chosen and how the winner will be contacted.
•    When you enter a competition, you will also be bound by the terms relevant to the platform on which the competition is run.


14. Events outside our control

We will not be in breach of this agreement or otherwise liable for any delay in performance to the extent that any delay or failure is due to circumstances beyond our reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, weather event, flood, fire, explosion, accident, extreme weather, outbreak of disease, epidemic, pandemic, war, terrorist attack or civil emergency.


15. General – intellectual property

This website comprises images, text, formats and styles of presentation, software and material analogous to us. All copyright and other moral ownership and intellectual property rights are either owned exclusively or are licenced to the company. You must not copy, modify, manipulate, transmit, perform, publish, display, licence or create derivative works from material accessed through this site. The website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the website and any transactions conducted on or through it.


It is a legal requirement that some of the information or communications we send to you should be in writing. When using our website, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with the legal requirement. This condition does not affect your statutory rights.


This website also contains certain company trademarks, graphics, logos and service names (‘devices’). The devices are owned exclusively by the company and may not be copied or reproduced in any format without the company’s consent.

The contract between you and us is binding on you and us and on our respective successors and assignees. You may not transfer, assign, charge or otherwise dispose of a contract, or any of your rights or obligations under it, without our prior written consent.
We may transfer, assign, charge, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time.


17. Severance

If any part of these terms is deemed unlawful, void or unenforceable, then that part will be deemed severed from these terms and will not affect the validity and enforceability of the remaining parts.


18. Our right to vary these terms

We have the right to modify and add to these terms from time to time. You will be subject to the terms stated here at the time that you place an order with us, unless any changes are required by law or governmental authority, or if we notify you of a change to these terms before we send you the Despatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms, unless you notify us to the contrary within seven working days of receipt of the products).


19. Law

These terms shall be governed by and interpreted in accordance with the laws of England and in the case of any dispute you agree that the exclusive jurisdiction of the courts of England shall apply. These terms do not affect your statutory rights.
